Representative Services

We have assisted in the development of a web based EU  Representative Service, established in Ireland.  This service is appropriate for Australian businesses who are required to appoint a representative under Article 27 of the European Union General Data Protection Regulation.

The Representative office provides the communications link between the EU Supervisory Authority and your local Australian business. Staffed by personnel in both the EU and Australia, this service provide a seamless communications channel between your data subject, the Supervisory Authority and your organisation.

The representative service includes a personalised portal for your business that can be used for communications, along with appropriate record-keeping as required under Article 30.

This service is provided by Juksta GDPR Representative Limited, located In Ireland and includes a 30 day free trial.

An Australian company does not need to appoint a “representative”, even if GDPR applies to it unless:

  • the processing it carries out is likely to result in a risk to the rights and freedoms of EU data subjects;
  • the processing is not occasional; or

    Note: “Occasional” is not defined in GDPR, but repetitive processing, such as payroll, is unlikely to be “occasional” and businesses running website analytics on persons in the EU is highly unlikely to be “occasional”.

The European GDPR Working Party interprets ‘regular’ (the opposite of “occasional”) as meaning one or more of the following:

      • Ongoing or occurring at particular intervals for a particular period
      • Recurring or repeated at fixed times
      • Constantly or periodically taking place.

The processing includes special categories of data as referred to in Article 9(1) or personal data relating to criminal convictions and offences referred to in Article 10.

“special categories of data” means personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation.”

Basic

Ideal for small companies and sole- traders that offer goods or services to a small number of individuals in the EU or who monitor behaviour of a small number of individuals in the EU (e.g. website analytics of a small business website). 

  • An EU presence in Ireland. (Suitable for enquiries from all EU Member States).
  • Customer care portal to allow GDPR  personal data requests.
  • Management portal to allow you to store and respond to requests.
  • Fee includes up to 5 personal data or supervisory authority requests per month.
  • Additional requests only 2 euros each.
  • Translation services are provided automatically via Google Translation API. Manual translation available at additional cost.

Business

Ideal for small to mid sized companies with a larger customer base of EU individuals receiving their goods or services or who monitor behaviour of a larger number of individuals in the EU (e.g website analytics of a larger traffic website) .

  • Everything included in the Basic plan, plus:
  • Fee includes up to 25 personal data or supervisory authority requests per month.
  • Additional requests only 1.50 euro each.
  • Customised notifications and escalations including by SMS.
  • Service level escalations to help manage SLA requirements for completion of requests.
  • Activity reports and exporting of requests.

Corporate

Ideal for medium to large companies with a significant customer base of EU individuals receiving their goods and services, monitor behaviour of a larger number of individuals or have additional corporate governance policy requirements they must fulfil.

  • Everything included in the Business plan, plus:
  • Fee includes up to 100 personal data or supervisory authority requests per month.
  • Additional requests only 1 euro each.
  • Complete branding of your request portal, including use of CSS.
  • Additional layer of authorisation before requests are responded to, suitable for QA, management or legal sign off.
  • Audit logging of all actions made within the application, including the user, timestamp and the action undertaken.
